3.3. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.4. Age Restriction: You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age.

3.5. Account Sharing and Transfer: Your account is personal to you and may not be shared with or transferred to any other individual or entity without our express written consent, except as provided in Section 9.3 regarding business transfers.

4. Services and Subscription Terms

4.1. Business Automation Hub offers various services, including but not limited to marketing automation, customer relationship management, and user-generated content features such as blogs, courses, and memberships.

4.2. Some aspects of the Platform are provided on a subscription basis. The specific terms of your subscription, including pricing and features, will be as agreed upon at the time of purchase.

4.3. Subscriptions automatically renew unless cancelled by you before the renewal date.

4.4. Cancellation: You may cancel your subscription at any time by using the cancellation form available at https://support.businessautomationhub.com/cancel. This is the only method for cancelling your subscription. Please refer to Section 7 of these Terms for our full Cancellation and Refund Policy.

5. Pay-Per-Use Features and Fees

5.1. Business Automation Hub offers certain features on a pay-per-use basis. By using these features, you acknowledge and agree to our Pay-Per-Use pricing model.

5.2. You are solely responsible for all fees incurred through the use of Pay-Per-Use features. This includes, but is not limited to, charges for:

  • Emails sent

  • Outgoing and incoming phone calls

  • SMS messages

  • Premium triggers and actions in workflows

  • Email verifications

  • Content AI usage (text and images)

  • Workflow AI executions

  • Conversation AI messages

  • WhatsApp conversations

  • AI-generated review responses

  • Any other Pay-Per-Use features as outlined in our current pricing structure

5.3. The current pricing for Pay-Per-Use features is available on our website. We reserve the right to modify these prices at any time, with notice provided to customers.

5.4. We maintain detailed records of your usage of Pay-Per-Use features. You may review your usage and associated charges through your account dashboard.

5.5. Charges for Pay-Per-Use features will be billed according to the billing cycle specified in your account settings. These charges are in addition to any recurring subscription fees for our services.Bullet list

6. Payment Terms

6.1. You agree to pay all fees associated with your use of the Platform.

6.2. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

6.3. You agree that we may charge your payment method for any paid features or services you purchase and for any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with your account.

7. Free Trial and Refund Policy

7.1. 14-Day Money-Back Guarantee: We offer a 14-day money-back guarantee from the date of purchase. You can request a full refund for the software subscription fee within 14 days of your initial purchase. 7.2. Refund Exclusions: This refund policy applies to the software subscription fee only. Set-up fees, charges for marketing services, and costs incurred through text, SMS, AI, and email usage are not eligible for refunds, as these are services rendered that cannot be returned.

7.3. Refund Process: To request a refund within the 14-day period, you must fill out the cancellation form available at https://support.businessautomationhub.com/cancel. We will process your refund promptly, aiming to make the process as smooth and hassle-free as possible.

7.4. Cancellations After 14 Days: You have the freedom to cancel your software subscription at any time. If you decide to cancel after the initial 14-day period, your subscription will be terminated at the end of the current billing month. Please understand that no refunds will be granted for cancellation requests made after the 14-day money-back guarantee period.

7.5. Cancellation Process Agreement: By subscribing to Business Automation Hub, you agree to follow our designated cancellation process outlined on our platform. We've made this process straightforward and user-friendly to ensure you can easily request a cancellation if you decide our service is no longer right for you. To cancel your subscription, you must use the cancellation form available at https://support.businessautomationhub.com/cancel. This approach allows us to handle your request efficiently and ensure that all aspects of your cancellation are processed correctly.

7.6. No Chargebacks: By subscribing to Business Automation Hub, you agree not to initiate a chargeback with your bank or credit card issuer as a means to cancel your subscription. Chargebacks can be costly and time-consuming for both parties involved. If you have concerns or issues leading you to consider cancellation, we require you to reach out to our support team first. We are committed to resolving any issues you may encounter and assisting you through the cancellation process if needed.

7.7. Cooperation with Cancellation Process: Your cooperation with this process helps us continue to provide high-quality service and support to all our customers. Failure to adhere to this cancellation policy may result in the immediate termination of your account and may affect your ability to use our services in the future.

8. User Responsibilities and Conduct

8.1. You are solely responsible for your conduct and any content that you submit, post, or display on or through the Platform.

8.2. You agree not to use the Platform:

In any way that violates any applicable federal, state, local, or international law or regulationTo transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitationTo impersonate or attempt to impersonate Business Automation Hub, a Business Automation Hub employee, another user, or any other person or entityTo engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or which, as determined by us, may harm Business Automation Hub or users of the Platform or expose them to liability

9. Intellectual Property and Account Transfers

9.1. The Platform, along with its contents, features, and functionality (including but not limited to all information, software, text, images, video, audio, funnels, websites, emails, AI prompts, and the design and arrangement thereof) are owned by Business Automation Hub, its licensors, or other providers and are protected by U.S. and international copyright, trademark, patent, and other intellectual property laws.

9.2. These Terms permit you to use the Platform for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, perform, republish, download, store, or transmit any of the Platform’s content, except under the following conditions:

  • Your computer may temporarily store copies of materials incidental to accessing and viewing.

  • Your browser may store files cached for display enhancement

  • purposes.

  • You may print or download one copy of a reasonable number of pages for personal, non-commercial use, without further reproduction or distribution.

9.3. Business Automation Hub’s Intellectual Property: All workflows, templates, courses, funnels, websites, emails, AI prompts, and content created by Business Automation Hub are its exclusive intellectual property and are non-transferable. These assets may not be sold, licensed, or otherwise transferred to any third party.

9.4. Customer-Created Content: Any workflows or templates you create within your account are your intellectual property. You retain the right to export and keep this content upon terminating your account.

9.5. Business Transfers: If your business is sold, the new owner may take over your account, but they must agree to these Terms of Service to continue using the Platform.

10. User-Generated Content

10.1. Our Platform allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content") through features such as blogs, courses, and memberships. You are responsible for the User Content that you post on or through the Platform, including its legality, reliability, and appropriateness.

10.2. By posting User Content on or through the Platform, you represent and warrant that:

  • The User Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms

  • The posting of your User Content on or through the Platform does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity

10.3. We reserve the right to terminate the account of anyone found to be infringing on a copyright or posting inappropriate content as determined by our moderation policies.

10.4. You retain any and all of your rights to any User Content you submit, post or display on or through the Platform and you are responsible for protecting those rights.

11. Third-Party Services

11.1. The Platform may contain links to third-party websites or services that are not owned or controlled by Business Automation Hub.

11.2. Business Automation Hub has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

11.3. You acknowledge and agree that Business Automation Hub shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

11.4. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

12. International Use

12.1. Business Automation Hub's services are primarily intended for use in the United States, Canada, Australia, New Zealand, and select other countries. We reserve the right to restrict access from certain geographical areas due to security concerns or regulatory requirements.

12.2. You are responsible for complying with all local laws and regulations in your jurisdiction when using our services.

12.3. We make no representations that the Platform or its content are appropriate or available for use in all locations. Accessing the Platform from jurisdictions where its contents are illegal is prohibited.

13. Compliance and Regulatory Standards

13.1. HIPAA Compliance: We offer HIPAA-compliant accounts for medical offices and professionals. If you are a covered entity under HIPAA and wish to use our services for protected health information, you must subscribe to our HIPAA-compliant service tier and agree to our Business Associate Agreement.

13.2. You are solely responsible for ensuring that your use of our Platform complies with all applicable laws, regulations, and industry standards relevant to your business or profession.

14. Privacy and Data Protection

4.1. Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you.

14.2. You agree that we may process your personal data in accordance with our Privacy Policy and for the purposes set out in these Terms.

14.3. You are responsible for obtaining any necessary consents from your clients or customers for the processing of their data through the Platform.

15. Limitation of Liability

15.1. Affiliated Entities: For the purposes of this section, "Business Automation Hub" includes our affiliated entities: Chic AI Receptionist, Pivot and Prosper Marketing Solutions, and GROW Marketplace Directory (collectively referred to as "Affiliated Entities"). These Terms of Service govern your use of the Business Automation Hub platform, which may be utilized by our Affiliated Entities. Your use of specific services provided by our Affiliated Entities may be subject to additional terms.


15.2. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUSINESS AUTOMATION HUB, ITS AFFILIATED ENTITIES, NOR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM;

(ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM;

(iii) ANY CONTENT OBTAINED FROM THE PLATFORM;

(iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

15.3. Liability Cap: THE TOTAL LIABILITY OF BUSINESS AUTOMATION HUB AND ITS AFFILIATED ENTITIES, FOR ANY CLAIMS ARISING OUT OF THESE TERMS AND YOUR USE OF THE PLATFORM, SHALL BE LIMITED TO THE AMOUNT YOU PAID US FOR SERVICES DURING THE THREE (3) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

15.4. Basis of the Bargain: THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN BUSINESS AUTOMATION HUB AND YOU.

15.5. Exclusions: SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

15.6. Essential Purpose: YOU AGREE THAT THESE LIMITATIONS OF LIABILITY ARE AGREED ALLOCATIONS OF RISK CONSTITUTING IN PART THE CONSIDERATION FOR BUSINESS AUTOMATION HUB'S SERVICES TO YOU, AND SUCH LIMITATIONS WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY, AND EVEN IF BUSINESS AUTOMATION HUB OR ITS AFFILIATED ENTITIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES.

16. Indemnification

You agree to defend, indemnify and hold harmless Business Automation Hub and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Platform.

17. Term and Termination

7.1. These Terms shall remain in full force and effect while you use the Platform.

17.2. We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

17.3. If you wish to terminate your account, you may simply discontinue using the Platform, or notify us that you wish to delete your account.

17.4. Cancellation Process: To cancel your account, you must use the cancellation form provided on our website at

https://support.businessautomationhub.com/cancel. This is the only acceptable method for cancelling your subscription. Initiating a chargeback through Stripe or other payment processors is not an acceptable method of cancellation.

17.5. Improper Cancellations: Failure to follow the proper cancellation procedure may result in the continuation of billing or the suspension of services. We reserve the right to dispute any illegitimate chargebacks and to recover any associated costs as permitted by law.

17.6. Data Retention: Upon termination of your account, we will retain your data for a period of [X] days, after which it will be permanently deleted. During this period, you may request a copy of your data by contacting our support team.

17.7. Information Retention: We reserve the right to retain certain information as required by law or for legitimate business purposes. The retained information will remain subject to the terms of our Privacy Policy.

17.8. Survival of Terms: All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Changes to Terms

18.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

18.2. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform.

19. Governing Law and Dispute Resolution

19.1. These Terms are governed by the laws of Georgia, USA. You agree that any dispute related to these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Hall County, Georgia.

19.2. Any dispute arising from these Terms or your use of the Platform will be resolved through binding arbitration conducted by the American Arbitration Association in Hall County, Georgia, unless we both agree to another location or remote proceedings.

19.3. You agree to resolve disputes only on an individual basis and waive any right to bring or participate in a class, consolidated, or representative action.

19.4. Notwithstanding the above, either party may seek injunctive relief in court for intellectual property infringement.

19.5. Any claim must be filed within one (1) year after it arises, regardless of any law to the contrary.

20. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

21. Waiver

No failure or delay by Business Automation Hub in exercising any right or enforcing any provision of these Terms shall constitute a waiver of such right or provision. A waiver of any default is not a waiver of any subsequent default. No waiver is effective unless it is in writing and signed by an authorized representative of Business Automation Hub.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by us on the Platform, shall constitute the entire agreement between you and Business Automation Hub concerning the Platform and Services.
